EPA Issues Proposes NSPS Rule

The EPA has proposed New Source Performance Standards (NSPS) Updates and Emissions Guidelines in an effort to "reduce methane and other harmful pollution from the nation's oil and gas industry".

Background: June 30, 2021 -- President Biden signed into law a joint Congressional resolution disapproving the 2020 final policy amendments to EPA's 2012 and 2016 New Source Performance Standards (known as the "policy rule"). These amendments were intended to make it less burdensome for the industry to comply with the New Source Performance Standards. Through the use of the Congressional Review Act, President Biden eliminated the amendments and as of November 2, 2021 has issued a proposal that would expand and strengthen emissions reduction requirements that are currently on the books for new, modified and reconstructed oil and natural gas sources, and would require states to reduce methane emissions from hundreds of thousands of existing sources nationwide for the first time. How to Comment on the EPA's Proposed Rule (Docket ID No. EPA-HQ-OAR-2021-0317), once it is published in the Federal Register.

EPA prefers that you submit comments online through the Federal eRulemaking Portal. Visit https://www.regulations.gov/ and type EPA-HQ-OAR-2021-0317 in the search box. That will take you to a link to the docket for the proposed rule. Under the link, there will be a button that says “Comment.” Click on that button to submit your comments, or you can open the link, and use the blue button in the upper left to enter your comments.
